Section 301 Tariff Increases Finalized by the USTR

The Office of the United States Trade Representative (USTR) has finalized modifications to the tariffs imposed on China following a four-year statutory review of the Section 301 investigation into China’s trade practices regarding technology transfer, intellectual property, and innovation. The modifications largely align with the proposals announced in May 2024 and aim to protect American businesses and workers from China’s unfair trade practices. Despite some changes in China’s practices, the review found that harmful forced technology transfer practices, including cyber theft and industrial espionage, persist and have, in some cases, intensified.

The finalized updates adjust the timing and rates for tariffs on items such as face masks, medical gloves, needles, and syringes, while granting specific exclusions for certain goods, like enteral syringes and ship-to-shore cranes ordered before May 14, 2024. Additionally, the updates expand the scope of machinery exclusions to cover five new tariff lines and propose modifications related to tariffs on tungsten, wafers, and polysilicon. The USTR will soon launch the machinery exclusions process and initiate a comment period for proposed changes to tariff rates on specific items.

The four-year review involved extensive public and expert engagement, including nearly 1,500 public comments and numerous interagency meetings. The review concluded that while the tariffs have helped reduce exposure to harmful practices and supported supply chain diversification, they have also resulted in minor negative economic impacts due to retaliatory tariffs by China.
